Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User," "you," or "your") and AI Moving LLC ("Company," "we," "us," or "our"). By accessing or using the AI Moving platform (the "Platform"), website, mobile application, and services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service.

1. Description of Service

AI Moving provides a digital platform that uses artificial intelligence and video scanning to generate moving estimates. Our Service allows users to upload videos of their property, which are analyzed by AI models to assess the size, scope, and complexity of a moving job. Based on this analysis, we provide estimated costs and connect users with moving service providers in the Los Angeles area and beyond. We are a technology platform and do not provide moving services directly.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you have the legal authority to enter into this agreement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

To use certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate your account if you provide false or misleading information.

4. How the Platform Works

The AI Moving platform operates as follows:

1. You upload a video of your property using our mobile application or web interface
2. Our AI models analyze the video to extract property dimensions, room layouts, and inventory information
3. Based on this analysis, we generate a moving estimate with a price range and detailed breakdown
4. You can review the estimate and proceed with booking or request quotes from moving partners
5. Once you confirm a move, we facilitate communication between you and selected service providers

Estimates are generated by artificial intelligence and should be treated as preliminary assessments. Final pricing may vary based on on-site inspections, unforeseen circumstances, and additional factors. You acknowledge that AI estimates are not guaranteed and may differ from actual moving costs.

5. Video Scanning and AI Analysis

By uploading videos to the Service, you grant us a non-exclusive license to store, process, and analyze the video content using artificial intelligence. Your videos may be processed by our AI systems, and extracted data (dimensions, layouts, inventory) will be used to generate estimates.

You represent that you have the right to upload the videos and that the videos do not violate anyone's privacy, intellectual property, or other rights. You are solely responsible for the content of your videos. We reserve the right to remove videos that we determine violate these Terms or applicable law.

6. Booking and Payments

Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a payment, you authorize Stripe to charge your payment method. Payment information is subject to Stripe's terms and privacy policy. We do not store credit card information on our servers.

Booking Confirmation

Once you submit a booking request and complete payment, you will receive a confirmation email with move details and information about your assigned service provider. The confirmation email constitutes acceptance of your booking.

Dispute Resolution for Bookings

If you dispute a booking charge or believe there was an error, contact us within 14 days of the transaction. We will investigate and work with Stripe to resolve the issue. Chargeback requests must be filed with your payment provider according to their procedures.

Pricing

All prices are displayed in US Dollars (USD). Prices may vary based on your location, the complexity of the move, and current market conditions. We will provide a detailed price breakdown before you complete your booking. You acknowledge that prices generated by AI are estimates and may be subject to adjustment based on on-site assessment.

7. Cancellation and Refund Policy

How to Cancel

To cancel a booking, log in to your account, navigate to your bookings, and select the cancel option. You will receive a confirmation email with your refund details. Refunds are processed through the Platform within 5-7 business days to your original payment method.

Rescheduling

You may reschedule your move up to 48 hours before the scheduled date without penalty. Rescheduling may be limited based on service provider availability. Contact support at legal@aimoving.app to reschedule.

8. Price Adjustments

We reserve the right to adjust final pricing based on factors not captured in the AI estimate, including but not limited to: additional items discovered on moving day, access difficulties at the property, excessive distance to moving truck, stairs or elevators, and time constraints. Any price adjustments will be communicated to you before the move begins, and you will have the opportunity to accept or cancel the move without penalty if the adjustment exceeds 10% of the original estimate.

9. User Responsibilities

Your Obligations

• Provide accurate information about your property and moving needs
• Ensure you have the legal right to grant access to the property for video recording
• Disclose all relevant information that may affect the move (stairs, narrow corridors, fragile items, special equipment, etc.)
• Be present or provide access on the scheduled move date
• Comply with all applicable laws and regulations in your jurisdiction
• Use the Service only for legitimate moving purposes

Prohibited Activities

• Upload videos containing private information of other people without consent
• Use the Service to harass, threaten, or abuse others
• Attempt to reverse-engineer or bypass our AI models
• Use the Service for illegal purposes or in violation of applicable law
• Interfere with or disrupt the functioning of the Platform
• Create multiple accounts to circumvent our policies

10. AI Moving Is Not a Moving Company

You acknowledge and agree that AI Moving is a technology platform and service marketplace, not a moving company. We do not own moving trucks, employ movers, or provide moving services directly. We connect you with third-party service providers who are independent contractors, not employees or agents of AI Moving.

You understand that AI Moving is not responsible for the actual moving services, the conduct of service providers, property damage, or loss of items. Service providers are solely responsible for their own actions and the quality of their services. Any disputes regarding actual moving services, damage claims, or service quality should be directed to the service provider first.

Our role is limited to providing the technology platform to generate estimates and facilitate introductions. We do not oversee, control, or manage the actual execution of moving services.

11. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, software, and design elements, is the exclusive property of AI Moving or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or display any content without our express written permission.

Our AI models, algorithms, and analytical methods are proprietary and confidential. You agree not to attempt to reverse-engineer, decompile, or extract our proprietary technology.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AI MOVING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, OR ERROR-FREE; (C) THAT DEFECTS WILL BE CORRECTED; AND (D) THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL CODE.

AI MOVING DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI-GENERATED ESTIMATES. ESTIMATES ARE PRELIMINARY AND SUBJECT TO CHANGE BASED ON ON-SITE ASSESSMENT. FINAL MOVING COSTS MAY DIFFER SIGNIFICANTLY FROM INITIAL ESTIMATES.

13. Limitation of Liability

IN NO EVENT SHALL AI MOVING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF AI MOVING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF AI MOVING FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AI MOVING IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless AI Moving, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (A) your use of the Service; (B) your violation of these Terms; (C) your violation of any applicable law or regulation; (D) content you upload or submit; or (E) any third-party claim that your use of the Service infringes their rights.

15. Dispute Resolution

Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@aimoving.app. We will work in good faith to resolve the issue within 30 days.

Arbitration Agreement

You and AI Moving agree that any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration, not in court. Arbitration will be conducted by a single neutral arbitrator under the American Arbitration Association (AAA) rules. You waive your right to a jury trial and the right to participate in a class action. The arbitrator's decision is final and binding.

Exceptions

Notwithstanding the arbitration agreement, either party may seek injunctive relief in court to prevent irreparable harm. Additionally, small claims court disputes (up to jurisdictional limits) may be pursued in the appropriate state or local court.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and AI Moving regarding the Service and supersede all prior and contemporaneous agreements, understandings, and communications, whether written or oral.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be effective upon posting to the Platform with a new "Last Updated" date. If changes materially affect your rights or obligations, we will provide additional notice (e.g., via email). Your continued use of the Service following such notice constitutes acceptance of the modified Terms.
